Points of law

The Supreme Court of the Russian Federation reversed the decision of the magistrate judge in order to ensure uniformity of case law and legality. In so deciding, the Supreme Court of the Russian Federation was guided by the provisions of article 401 of Civil Procedural Code of Russia, according to which the Consulate General of Ukraine enjoyed immunity from jurisdiction of Russian courts unless it expressly consented to the exercise of jurisdiction.

Summary of the case

Ms. P brought a claim against the Consulate General of Ukraine seeking compensation for the non-performed services as well as for the non-pecuniary damage. Her claim was satisfied in part by a magistrate judge.
