Employment relations are not covered by immunity of jurisdiction

Summary of the case

There was an employment relation between the plaintiff and the defendant, thus Spanish Law is applicable. There is not immunity of jurisdiction because the plaintiff is not a diplomat and because the Basel Convention on immunities of States may be applied by analogy; this Convention does not recognise immunity of jurisdiction in employment relations. International Labour Organization is condemned because of unfair dismissal.
