Points of law

A foreign State enjoys immunity in the UK in relation to proceedings in respect of torture committed outside the UK. The exception to immunity in respect of acts occasioning personal injury or death, applies only when they are caused by acts or omissions in the UK (section 5, State Immunity Act). There is no general exception to immunity in respect of acts of torture or other violations of international law.
