Points of law
The case concerned a debt obligation of the State of Iraq towards a Finnish company. As Iraq did not react to the claim, and as the Court found that the claim was not unfounded, it entered a default judgment against Iraq on 9 December 1994. Iraq moved to vacate the judgment.At the beginning of the proceedings, Iraq claimed immunity, but later waived the right to invoke immunity. Therefore, the Court found that it was competent to consider the case.
